Welcome to The Oaks Cellars Pte Ltd (“The Oaks Cellars”).  The Oaks Cellars provides its services to you subject to the following conditions and all users of this website agree that access to and use of this website is subject to the following terms and conditions and other applicable law. If you visit or shop at The Oaks Cellars or purchase from our website, you are agreeing to these conditions. Please read them carefully. If you do not agree to these terms and conditions, please do not use this site.

The Oaks Cellars reserves the rights to modify the terms and conditions here in without notice. Your continued use of the website or the services of The Oaks Cellars after any such changes constitutes your agreement to such changes.

 

1. Registration
You will need to register an account to use some of the services available on the website.  By registering an account you agree to provide information about yourself that is true, accurate, current, and complete in all respects. 

Once registered, you agree to accept responsibility for all activities conducted through your account including receiving emails on special promotions we hold.  As part of our Privacy Policy, you may opt-out of receiving these communications by replying to “unsubscribe” in the subject line of the email. 

If your personal identifiable information changes, or if you no longer desire our services, you may correct, update or request for your personal data to be removed by emailing: customercare@oaks.com.sg.
 

2. Legal Age to Purchase Alcoholic Beverages
The Oaks Cellars does not sell alcohol to persons under the age of 18, being the legal drinking age in Singapore.  By using this site you represent that you are over the age of 18, and are able to purchase or consume alcohol in Singapore.

 

The Oaks Cellars makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 18. By purchasing from this website you are acknowledging that the person receiving a shipment of alcoholic beverages from The Oaks Cellars is over the age of 18.

 

A breach of the regulation is an offence, punishable with a fine not exceeding S$10,000.

 

Where orders are received from countries other than Singapore, by using this site, you represent that you have reached the legal age required in the country of residence, and are allowed to purchase or consume alcohol.

 

3. Images

Product images are for illustrative purposes only and may differ from the actual product. Due to differences in monitors, colours of products may also appear different to those shown on the site. Photos of actual products can be provided upon customer request if required.

 

4. Pricing
Products on this website are priced in Singapore Dollars (SGD) inclusive of Goods and Services Tax (GST) and apply strictly to items purchased online only.    

Promotional offers and prices are as stated, with no further discounts available.

 

At www.oaks.com.sg, our commitment to our customers is to offer convenience, service and product availability online at competitive prices. Please note that price variations are expected between our website and retail stores according to a number of factors, in a way that offers best value to each store’s individual customer base. The prices will be different because the website and retail stores may choose to offer items at different prices or may run different promotional events at different times. Additionally, our website may offer a product, price or promotion that is not available in the retail stores.


Although we endeavour to ensure that all pricing information on this website is accurate, an error may occasionally occur and goods may be mispriced.  Where a pricing error is discovered, we will, at our discretion, do either of the following:
a.     Contact you and enquire if you wish to cancel your order or continue with the order at the correct price; or
b.     Notify you that we have cancelled your order.

We will not be obliged to supply goods at the incorrect price.
We reserve the right to adjust prices, offers, goods and specifications of goods at our discretion at any time before (but not after) we accept your order.  Prices are subject to currency and market fluctuations, changes in duty and GST as well as stock remaining unsold.
Where an end date is specified on any offer on the website, it is intended as a guide only. We reserve the right to change prices at any time.

 

5. Ordering On-line
Placing your order online is simple and convenient.  Please follow the steps below:
1.     Select your products and add them to the shopping cart
2.     Login to your account/ Register or continue as a Guest
3.     Enter your shipping information
4.     Confirm your order
5.     Pay with Paypal, your Visa Card, Master Card or American Express Card
Orders may be delayed by transfers of money or credit card authorisations not being confirmed by the respective banks. It is the customer’s responsibility to contact their bank to speed up this process if the order is required urgently.
The placing of an order anywhere on our website does not constitute a contract. A contract is made only when we accept your order and have processed your payment.

We reserve the right not to accept any order. 

 

6. Email confirmations

Upon the completion of your order, you will receive the following emails to the email address specified in your account:

The first email is an acknowledgement and does not constitute an acceptance of your order.

Once the payment is confirmed, the second email with invoice enclosed will be sent. We will process with dispatching the items or getting them ready for collection. 

An email notification will be sent once your order have been dispatched/collected.

** For Standard Delivery, orders will be processed and dispatched within 48h, subject to available delivery dates and timeslots shown during order check out. Orders received on Friday will be dispatched on the following Monday.

* For Next Working Day Delivery, system will offer you the next available delivery slot based on the next available working day for delivery (exclude Sundays and P.H.). Please confirm date and time before proceeding.

* For Express Same Day Delivery, order must be received before 12PM of the day.

* Available timeslots for each delivery mode will be shown during order check out.

* No deliveries will be made on Sundays & Public Holidays.

* No delivery will be made to out of bound areas such as Jurong Island, Changi Airport, Cargo Complex, PSA Singapore Terminals, Embassies and Singapore Armed Forces Camp Sites.

You will be informed of the applicable delivery charge of your order when you confirm the items you wish to purchase by clicking on the “check out” button.

 

8. Self- Collection

 

* $20 Processing charge is applicable for order value below S$250.

* Orders will be processed and delivered to your preferred collecting outlet within 2 working days, subject to available collection outlets and dates shown during order check out.

* For self-collection orders received on Friday after 2pm will be dispatched to the collecting point on the following Monday.

* You need to present the order confirmation email and a photo ID when the order is collected

* Please collect the goods within 7 days from the collection date stated in the invoice.

*Important note for uncollected goods :

After 7 days from the collection date stated in the invoice, uncollected goods will be returned back to The Oaks Cellars Warehouse (315 Outram Road #12-09, Singapore 169074 Opening Hours: Mon-Fri 9am-6pm, Sat 9am – 1pm).

Please allow 2 working days for us to process your next collection from our warehouse or you may contact us at customercare@oaks.com.sg for further assistance.

To arrange for your items to be redirected to another location of your choice, a re-delivery fee of $20 is applicable. Please contact us via email at customercare@oaks.com.sg or call us at 6224 2611. We will do our best to reschedule your delivery as soon as possible.

 

We will inform you immediately via email or telephone if we expect delays due to reasons such as temporary stock shortage.  Delays in delivery shall not give the customer the right to cancel orders. 
In instances where one or more items in your order are not available for immediate delivery, we will notify you and offer a substitution or refund or we can hold your order until all items are available for delivery.

 

9. Re-Delivery

 

We reserve the right to charge for the re-delivery of orders that have not been completed due to incorrect or inaccurate information provided by the customer, including but not limited to the intended address at which the goods are to be delivered. Whilst we make every effort to deliver all your goods at the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.

If you are not able to let us know ahead of time and miss your delivery, please contact us via email at customercare@oaks.com.sg or call us at 6224 2611. We will do our best to reschedule your delivery as soon as possible.

Please note that if no one is at the delivery location to receive the order during the chosen delivery slots, The Oaks reserves the right to charge the Customer re-delivery fee of S$20.00.

 

10. International Shipping

 

We offer International Delivery using Courier Services. Deliveries require a lead-time of 7-10 working days for all orders. If you have not received your goods within 15 days please contact us immediately. You may opt for Express Services if you need to receive your order by a specific date, or for those of higher value.

 

• All products are offered “Ex-Warehouse”.  We advise Customer to insure the shipment accordingly.  Goods are dispatched by a third party courier and their terms and conditions apply.

• Customer needs to know the licensing requirement in their own country and The Oaks Cellars will not be held responsible should any problem arise from country of destination..

• Customer is wholly responsible for any and all local customs and import duties and taxes attaching to the goods shipped.

• Our Customer Care will advise on shipping rate and insurance premium based on the recipient address provided. 

• Any claim arise will be handled directly by the Courier Agent.

• We do not accept return, exchange or refund once the package depart from our warehouse.

• The Oaks Cellars reserves all right to cancel or stop the shipment should there is violation to our terms and conditions.

 

*For International Shipping enquiries, please contact us at customercare@oaks.com.sg. Kindly include the recipient country post code, and the items you would like to purchase; Our Customer Care team will assist you from there.

 

11. Ownership

All wines and spirits or other goods ordered shall remain the property of The Oak Cellars until payment is received in full.
 

12. Taxes or Other Charges
All taxes or other charges imposed by law on the goods, including but not limited to GST, surcharges, duties and those from all governmental authorities, shall be borne by the customer unless the law specifically provides that such payment must be borne by us.

 

13. Fee
In the event of refund as agreed upon, a processing fee of 3% will be applied.

 

14. Out of Stock Items
All goods are offered subject to availability.  Whilst we continually monitor our inventory to ensure the accuracy of information on our website, there may be occasions when certain products sell out or simply are no longer available. In such a situation, The Oaks Cellars will make suggestions for suitable alternative items. We will email you our recommendations and you can either accept those recommendations or select other items of your choice.  In the event you choose not to accept our suggested alternatives or change your original order, we will simply ship out the available items minus the out-of-stock items or cancel the order on your behalf as applicable.

15. Delivery and Receipt of Goods

All goods are deemed delivered and received by the customer upon acceptance and acknowledgement of such delivery by the customer or anyone having actual, implied or ostensible authority from the customer to do so.

 

16. Inspection and Returns Policy

The Oaks Cellars makes every effort to ensure that all products sold are of high quality and we take customer satisfaction seriously.

 

Wines and spirits age and mature in different ways within the bottles and it is beyond our control on top of all reasonable attempts that we could ensure the good condition of the wine. Hence, we cannot accept returns for any wines should they be corked, tainted or fatigued in any way and we shall not bear any liability based on subjective judgements of wine taste or drinkability.

 

*Please be reminded that wines are purchased at buyers’ risk. We do not accept return or refund after customer has agreed to purchase.

 

For wine accessories and lifestyle products, customers shall inspect all goods ordered upon receipt of their order. If for any reason upon inspection you are dissatisfied with your order, please contact us within 48hours of the receipt of the order. 17. Force Majeure
Neither The Oaks Cellars nor the customer shall be liable to each other for failure in the performance of any of the obligations imposed by the terms and conditions on this website arising from an act of God, war, sabotage, rebellion, riots, hostile activities, interruptions of transportation or inability to obtain necessary labour, materials of facilities, default of any supplier, acts of governmental or quasi-governmental authorities, regulations or restrictions imposed by law, regulations or by court action, fires, explosion, floods, storms or other catastrophes, (whether or not the kind described herein) over which the affected party has no reasonable control and which is of such nature as to make timely compliance impracticable.

 

18. Disclaimer of Warranties and Limitations of Liability
This website is provided by The Oaks Cellars on an ‘as is’ and ‘as available’ basis.  The Oaks Cellars makes no representations or warranties of any kind express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.

The Oaks Cellars makes every effort to ensure that its servers, website and emails sent from its website are free from viruses and other harmful components. The Oaks Cellars, however, will not be liable for any damages of any kind arising from the use of this website, including, but not limited to direct, indirect, incidental, punitive, and consequential damages. lost revenue or profits, lost or damaged data or other commercial or economic loss that result from your use of, or inability to use, this website.

The Oaks Cellars reserves the right to withdraw or amend any item on its website without notice. We will not be liable if for any reason the website is unavailable at any time or for any duration.

If this limitation of liability provision shall be deemed unenforceable, either in whole or in part, such enforceable parts shall be deleted and the remaining parts shall remain in full force and effect and The Oaks Cellars’ liability shall be limited to the greatest extent permitted by law.

All content appearing on the website, including but not limited to graphics, logos, text, images and other features, are the copyrights, trademarks and other intellectual property owned, controlled or licensed by The Oaks Cellars or third parties. This content is protected by copyright separately and as a collective work or compilation under Singapore and international copyright law and is the property of The Oaks Cellars, its licensors, or the party credited as the provider of the content or other third party owners of the content, as the case may be.

As a user of this website, you may not copy, distribute, transmit, reproduce, publish, create derivative works or in any way use any of the content on this website without the prior written permission of The Oaks Cellars. This prohibition includes without limitation the publication of any part of this content on any other website, selling or offering it for sale, or using it to create any kind of database. 20. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of Singapore. By accessing this website, you irrevocably submit to the non-exclusive jurisdiction of the Singapore courts.

If at any time any of the terms and conditions on this website is or becomes illegal, invalid or enforceable in any respect, the legality, validity and enforceability of all the remaining terms and conditions on this website shall not be affected or impaired thereby.

 

22. No Waiver
If you breach the terms and conditions on this website and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the terms and conditions.
